Renting With a Housing Voucher in Montgomery: What Tenants Should Know

For Tenants Aug 7, 2025 Brandon McIntyre, Regional Property Manager & REALTOR®

If you've received a Housing Choice Voucher (Section 8), congratulations — you now have access to quality housing in the private rental market. This guide explains how to use your voucher in Montgomery, what landlords look for in applicants, how inspections work, and your rights and responsibilities as a voucher holder.

How the Housing Choice Voucher Works

Your voucher covers a portion of your rent — the Housing Authority of the City of Montgomery (HACM) pays the landlord directly through a Housing Assistance Payment (HAP). You pay the difference between the HAP amount and the total rent (your "tenant portion"), which is typically 30–40% of your adjusted monthly income. For example, if rent is $1,100 and your HAP covers $900, you pay $200/month out of pocket.

Finding a Voucher-Friendly Home

Not all landlords accept vouchers, but many do — especially professional property managers. The best places to search include AffordableHousing.com (the #1 platform for voucher holders), Zillow and Apartments.com (filter for "accepts Section 8"), and James-Hawkins' Tenant Turner listings. You typically have 60–120 days from voucher issuance to find a unit and complete the process before the voucher expires, so start searching immediately.

The Application Process

Voucher holders go through the same screening process as market-rate tenants — credit, background, rental history, and income verification. Having a voucher does not exempt you from screening requirements. Prepare the same documents as any applicant: ID, income verification, landlord references, plus your voucher paperwork and PHA caseworker contact information.

The HQS Inspection

Before you can move in, the property must pass a Housing Quality Standards (HQS) inspection conducted by HACM. This ensures the unit meets health and safety standards. The landlord is responsible for preparing the property; James-Hawkins conducts pre-inspections on all our properties to ensure they pass on the first attempt. The inspection adds approximately 1–3 weeks to the move-in timeline.

Your Rights as a Voucher Holder

You have all the same tenant rights as market-rate renters plus additional protections: your landlord cannot charge you more than your approved tenant portion, must maintain the property to HQS standards, and cannot terminate your lease for voucher-related reasons. You can report housing quality concerns directly to HACM.

Your Responsibilities

As a voucher holder, you must: pay your tenant portion on time every month, maintain the property in good condition, allow access for annual HQS inspections, report income changes to HACM within the required timeframe, complete annual recertifications, and follow all lease terms. Violating program rules can result in voucher termination.

Frequently Asked Questions

Can I use my voucher anywhere in Montgomery?

Yes — you can use your voucher at any property where the landlord agrees to participate in the program and the unit passes HQS inspection. You can also "port" your voucher to other cities if you need to relocate.

What if I can't find a home before my voucher expires?

Contact your HACM caseworker immediately if you're having trouble finding housing. Extensions may be available. Using AffordableHousing.com and working with voucher-experienced property managers like James-Hawkins significantly speeds up the process.

Can the landlord raise my rent?

Rent increases must be approved by HACM through the rent reasonableness process. Your landlord cannot unilaterally raise rent — any increase must comply with HUD guidelines and your voucher terms.

Do I need renters insurance?

The Housing Authority does not provide personal property or liability coverage. Renters insurance is strongly recommended to protect your belongings.
