Handling Late Rent Payments in Montgomery: Strategies That Work

For OwnersNov 25, 2025Austin Hawkins, Co-Principal & COO

Late rent is one of the most stressful parts of being a landlord. Having a clear, consistent process makes all the difference — both for your cash flow and your sanity.

Set Clear Expectations From Day One

Your lease should spell out: when rent is due, the grace period (if any), the late fee amount, and the consequences of non-payment. At James-Hawkins, these terms are standardized across all our leases for consistency and legal compliance.

Our Collection Process

  1. Day 1: Rent is due
  2. Day 4: Late fee applies (per lease terms)
  3. Day 5: Courtesy reminder sent via text/email and through the tenant portal
  4. Day 7: Personal phone call from our team
  5. Day 10: Formal pay-or-quit notice posted (7-day notice per Alabama law)
  6. Day 17+: If unresolved, eviction proceedings begin with our attorney partner

For Section 8 Properties

Section 8 tenants receive the government portion of rent directly from the Housing Authority — typically 60–80% of the total rent. This dramatically reduces late payment risk. The tenant’s portion is smaller and easier to manage. It’s one of the many advantages of Section 8 investing.

Post-Move-Out Collections

For tenants who leave owing money, we partner with Hunter Warfield to pursue post-move-out collections. Your financial interests are protected even after the tenant is gone.
